The question and the evidence burden

Question: Did the September CLARITY substitute retain the February bill’s express affiliate-independence sentence?

What would establish it: Compare the text of the specific exchange and broker/dealer subsections in both published bill versions; identify any broader related provisions elsewhere.

Method: legislative text comparison

What the documents establish

The February S.3755 language says the designated officer is responsible solely to the specified exchange, broker, or dealer and not to another affiliated entity. The September 14 substitute sections on printed pages 516 and 549 require designation and duties but do not repeat that categorical sentence.

Limits and competing context

The September substitute includes other conflict-management duties and rulemaking authority. Absence of the earlier sentence from the corresponding officer sections does not, on its own, establish that the later framework permits every conflicting affiliate role or that no alternate legal restriction could apply.

Still unanswered
